The Service is provided "as is" without guarantees regarding availability, lost user data/settings, or delivery of user communications. You are responsible for obtaining your own internet access, which may involve third-party fees we do not cover (such as ISP charges). You must provide your own equipment to access the Service.

Smart Web Ninja provides website management and maintenance services and does not function as an internal development team.

Registration Information

To use Smart Web Ninja services, you affirm you are legally able to form a binding contract and are not prohibited from receiving services under applicable laws. You agree to:

(a) Provide accurate, current, and complete registration information.

(b) Maintain and promptly update your registration data to keep it accurate, current, and complete.

If any registration information is untrue, inaccurate, outdated, or incomplete, Smart Web Ninja may suspend or terminate your account and refuse current or future service use.

Account Passwords and Security

When registering, you will create a password and account username. You are responsible for keeping this password and account secure and confidential. This includes:

(a) Immediately notifying Smart Web Ninja of any unauthorized account access or other breach.

(b) Logging out of your account at the end of each session.

Smart Web Ninja is not liable for any damages or losses resulting from your failure to follow these security measures.

Payments and Subscriptions

By selecting a service, you agree to pay Smart Web Ninja the advertised one-time, monthly, or annual fees associated with the selected service plan. Subscription payments are charged at the start of each billing period.

All fees are non-refundable unless otherwise required by law.

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless canceled. By enrolling in a subscription service, you authorize Smart Web Ninja to charge your payment method on file for the applicable subscription fees and taxes.

Clients may cancel their subscription at any time by submitting a request through the Smart Web Ninja support system. Cancellation will take effect at the end of the current billing period, and service will continue through that period.

Plan Details

Service features, support levels, and included services vary depending on the plan selected. For full details regarding services and support included with each plan, please refer to the Smart Web Ninja Plans & Pricing page.

Website Management Service Scope

Smart Web Ninja provides website hosting, maintenance, monitoring, and website management services as described on the Plans & Pricing page of our website.

Monthly service plans are designed to provide ongoing website maintenance and small updates. Tasks covered under these plans typically include website monitoring, system updates, security management, backups, and small website updates or adjustments.

Website updates included with monthly plans generally consist of tasks that can be completed within approximately 30 minutes or less. Examples include text edits, image replacements, publishing blog posts, updating page content, plugin configuration changes, and creating new pages using existing templates.

Requests that involve new custom page layouts, landing page design, recreating pages from external designs (such as Figma files or HTML mockups), large-scale layout changes, custom development, graphic design, or content creation fall outside the scope of the monthly service plans and may be quoted separately as project work.

Smart Web Ninja reserves the right, at its sole discretion, to determine whether a request falls within the scope of the monthly service plans.

Support Requests and Communication

All support requests must be submitted through the Smart Web Ninja support system.

Requests may be submitted by emailing support@smartwebninja.com or through the Smart Web Ninja client portal. Both methods automatically generate support tickets within our support system.

To ensure requests are tracked and completed properly, support is provided through the ticketing system only. Phone calls, Teams messages, Slack messages, or other internal messaging platforms are not supported support channels.

Smart Web Ninja typically responds to support requests within approximately 24–48 business hours. Response times may vary depending on request complexity and current workload.

Most support requests are then completed within 1–3 business days after the initial response, depending on complexity, current workload, and the scope of the request.

For requests requiring clarification, Smart Web Ninja may schedule a call if necessary.

Service Availability and Response Expectations

Smart Web Ninja provides services on a best-effort basis and does not guarantee immediate response times or real-time support.

Support requests are handled through the support queue and prioritized based on complexity and operational workload.

Client Responsibilities

Clients are responsible for providing all necessary website content, images, assets, and information required to complete requested updates.

Smart Web Ninja is not responsible for creating website content, marketing materials, or copywriting unless explicitly included as part of a separate service agreement.

Right to Refuse or Terminate Service

Smart Web Ninja reserves the right to refuse, suspend, or terminate service at any time and for any reason, at its sole discretion.

Service may be terminated in situations including, but not limited to:

  • Abusive or inappropriate behavior toward staff
  • Repeated requests outside the scope of service plans
  • Misuse of the support system
  • Failure to pay invoices or subscription fees
  • Circumstances where continuing service is not operationally feasible

If Smart Web Ninja terminates a service plan, service will remain active until the end of the current billing period unless otherwise determined by Smart Web Ninja.

Limitation of Website Liability

While Smart Web Ninja implements security, monitoring, and maintenance best practices, we cannot guarantee that websites will be completely free from security vulnerabilities, downtime, data loss, or third-party failures.

Smart Web Ninja shall not be held liable for damages resulting from website outages, security incidents, hosting failures, or third-party software issues.

License

You are granted a limited license to view Smart Web Ninja website materials temporarily for personal, non-commercial purposes only. You may not:

  • Modify or copy materials from the website.

  • Use materials for any commercial purpose or public display.
